General information regarding the www.sesc.irta.cat website

The domain www.sesc.irta.cat (also www.sesc.cat) is a domain of the Institute of Agri-Food Research and Technology (IRTA), with Tax ID (NIF) no. Q-5855049-B and registered office at Torre Marimon, Ctra. C-59, Km. 12,1, postcode 08140 Caldes de Montbui, (Barcelona), tel. 93 467 40 40 and email address (irta@irta.cat).

The IRTA is a company of the Government of Catalonia regulated by Parliament Law 4/2009 of 15 April (published in the BOE: Official State Gazette of 23 April 2009) and whose purpose is to contribute to the modernisation, improvement and promotion of competitiveness; to the sustainable development of the agricultural, food, silviculture, aquaculture and fisheries sectors, as well as those directly or indirectly related to the provision of healthy, quality food to end consumers; to food safety and food processing; and, in general, to the improvement of the well-being and health of the population.

The IRTA operates directly and through a consortium (including the IRTA, universities, the Spanish National Research Council, Provincial Councils, etc.) which can be defined as a cooperative R&D system.

Through the domain sesc.irta.cat, the IRTA manages a continuing education tool funded by the Catalan Public Health Agency (ASPCAT), part of the Government of Catalonia’s Health Department, and operated by the IRTA's Animal Health research programme in collaboration with the Autonomous University of Barcelona’s Faculty of Veterinary Medicine.

User Access

Access and/or use of the IRTA portals grants user status and entails acceptance of the conditions of access and use established in this legal notice, as well as the privacy and personal data policy. The aforementioned conditions shall be applicable regardless of the general contracting and e-commerce conditions that may be applicable to the features offered by the portal. The user undertakes to use the services and information provided on the portal www.sesc.irta.cat in good faith.

Initial access to the portal is free of charge. Even so, there may be for-pay features or services under the conditions established in each case.

In the event that the use of certain features or services requires user registration, said registration shall be carried out by means of data collection forms and subject to the provisions of the personal data protection legislation described in this legal notice.

In order to use the portal, minors must have the permission of their parents or legal representatives, who shall be responsible in this regard.

Protection of intellectual and industrial property rights

The Intellectual and Industrial Property rights of the portal are owned by IRTA www.sesc.irta.catand cover the contents and graphic elements, the source code, design, navigation structure, databases and other elements that are part of the website. Therefore, IRTA has exclusive exploitation rights in any format and, specifically, the rights of publication, distribution, transformation and public disclosure. Any users who wish to use or publish these contents or others that may be included in the future must do so in accordance with the provisions and respecting the restrictions of the Intellectual Property regulations and, in any case, with the authorisation of IRTA, without prejudice to the restrictions established in Royal Decree 1/1996, of 12 April, which approved the consolidated text of the Intellectual Property Law.

IRTA has an agreement with ASPCAT in relation to the publication on the portal, and provision to the same, of photographic, graphic and audiovisual elements produced by its staff, the rights of which belong to ASPCAT. These elements are subject to the same conditions set out in this clause, it being understood that the infringement thereof may also infringe upon the rights of these third parties.

Reservation of rights: IRTA explicitly reserves its rights in general with regard to all the contents published on the website that constitute intellectual or industrial property. In accordance with the provisions of Article 32 of the consolidated text of the Intellectual Property Act, the IRTA expressly opposes the use of any of the contents of the portal in any format, for the purpose of creating summaries or press reviews, audiovisual productions or for any other commercial purpose, without its prior express authorisation.

This legal notice does not imply any transfer of rights in favour of the user in relation to any of the elements of the website or its contents.

The following are prohibited under all circumstances:

  • Presentation of a page from the portal www.sesc.irta.cat or any of its contents in a window that does not belong to www.sesc.irta.cat by means of any technique or procedure including framing, in-line linking, etc.
  • The extraction of elements from the website that cause harm or loss to the IRTA in accordance with the provisions in force.
  • Commercial use of the of the www.sesc.irta.cat website.
  • The use of trademarks or distinctive signs, logos, colour schemes, structures, designs and, in general, distinctive symbols of any kind that are the property of the IRTA or ASPCAT, without their knowledge and the corresponding authorisation from the IRTA.
  • The use of content in activities that are illicit, illegal or against good faith and public order.
  • Spreading content or propaganda of a racist or xenophobic, pornographic or illegal nature, or that violates human rights.
  • Damaging the hardware or software of the IRTA, its suppliers or third parties; introducing or spreading computer viruses or hardware or software that may cause the aforementioned harm or loss.
  • Attempting to access and, as the case may be, use the email accounts of other users and modify or manipulate their messages.

Users may view the contents of this portal, copy them, print them on their computer or any other medium exclusively for their own personal and private use, with the exception of the contents covered by a Creative Commons licence, in cases where this is so indicated.

Privacy and personal data policy

A) Data collected through user registration forms and enquiry forms

The IRTA, as the party responsible for the website, in accordance with the provisions of Regulation (EU) 2016/679, of 27 April, on the protection of natural persons with regard to the processing of personal data (hereinafter, "GDPR"), and Law 34/2002, of 11 July, on information society services and electronic commerce (LSSICE), hereby informs you that it has implemented the necessary technical and organisational security measures to guarantee and protect the confidentiality, integrity and availability of the data entered.

B) Browsing data

The navigation system and the software needed for the website to function collect, by default, certain data, the transfer of which is inherent to the use of Internet communication protocols. This category of data includes the IP address or domain name of the computer used by the user to connect to the website, the URL of the requested resource, the time, the method used to query the server, the size of the file obtained in the response, the numerical code indicating the status of the response to the server, and other parameters relating to the operating system of the user's computer environment.

This information is not associated with specific users and is used for the sole purpose of obtaining statistical information on the use of the www.sesc.irta.cat website.

Responsibility in relation to content

The IRTA reserves the right to modify the contents of the website and to remove them, as well as to restrict or prevent access, either temporarily or permanently, without prior notice.

The IRTA is not responsible for the technical access, information or contents of other websites it links to or that can be accessed from the www.sesc.irta.cat portal.

The IRTA does not necessarily identify with the views expressed by its contributors.

Right of exclusion

The IRTA reserves the right to deny or withdraw access to its websites and/or the services offered without prior notice, at its own request or at the request of a third party, for any users who do not comply with these general conditions.

Chats, forums, polls and other interactive features

The www.sesc.irta.cat portal may have public and participatory sections (forums, chats, surveys, etc.), defined as those that are accessible to all users in general for interaction purposes. In certain cases, the user must first accept the conditions of participation and register. In the case of registration, in addition to the conditions of participation, the user must also accept the communication of personal data in order to comply with the policy and legislation on personal data protection.

With regard to the content that the user decides to submit to be included in these spaces, the following conditions of use and access are established:

1.- Liability: The IRTA is not responsible for the content of messages, information or opinions submitted by users and reserves the right to prevent access to illicit or illegitimate content or content that may harm legitimate rights of any kind, or to remove or delete content that has been submitted, especially in the event of a breach of these conditions.

2.- Intellectual Property:

  1. Without prejudice to the particular matters established in sections b), c) and d) below, the IRTA owns the Intellectual and Industrial Property rights of the sesc.irta.cat portal, including the contents and graphic elements, source code, design, navigation structure, databases and other elements that are part of the website.   2. Content provided by ASPCAT staff:
    The ASPCAT and the IRTA (the former as holder of the Intellectual Property rights of the images and other content provided by its staff, and the latter by express authorisation and non-exclusive free licence of the ASPCAT for everyone and for the maximum legal period until entry into the public domain), shall own all the intellectual property rights of the contents made available on the website, whether they are texts, photographs, graphics, etc., with the aim of promoting the section to which they have been submitted, as well as to use them in the activities and publications of the SESC (Support Service for Slaughterhouses, a continuing education and diagnostic support tool funded by ASPCAT and run by the IRTA). The rights shall have the scope indicated in section (a).
  3. Content provided by other users:
    Users may submit content to be published and made available on the portal. They may only submit content of which they are the original authors or have the rights of the owner of the same for the uses set forth in this clause, including the image rights of the persons appearing therein, without prejudice to providing the owner’s URL or having the right to link to the aforementioned content. Users take on the responsibility of complying with these requirements and guarantee indemnity to the IRTA and APSCAT in the event of third party claims.Users who submit content to be published and made available on the portal may be required to sign the "User Agreement" document available on the portal.
  4. All the contents referred to in b) and c) above:
    Content made available on the portal by ASPCAT staff or by other users and that constitutes intellectual property may be used under the Creative Common licence: (CC BY-NC-ND 4.0) citing source: sesc.irta.cat. This shall be indicated on a case-by-case basis.

3.- In accordance with the purpose of the SESC platform, the IRTA will respond to users’ queries whenever possible, as SESC is a service for asking professionals questions and promotes exchanges among professionals in the field of animal health and veterinary research.

4.- The personal data that appear in the interactive features and in the content of the same may not be used for benefits or uses that have not been expressly authorised by their owner. The user is responsible for the veracity of the data provided.

5.- Users shall respect the opinions of other users or participants, and shall refrain from using offensive or defamatory, racist or violent language, or language that is in violation of current legislation.

6.- No commercial or unauthorised communications may be made.

7.- Please note that personal data provided by users may be viewed by any other user or participant. In the case of data from third parties, the express consent of the said parties is required.

8.- In the case of surveys, users may participate anonymously, and the IRTA is not responsible for the use they may make of the results.

Subscriptions

Subscribing, to products or newsletters published by the IRTA, free or otherwise, through the www.sesc.irta.cat portal shall be voluntary and shall imply the acceptance of the conditions established in each case, which the user must expressly accept. It shall also imply consent to receive commercial information about IRTA products and services and those of related companies or consortium centres. Registering for these services authorises the IRTA to carry out this type of communication. The user may revoke this authorisation by means of a written notification in the format that the IRTA will specify in each case.

General

The IRTA shall prosecute any breach of these conditions, as well as any improper use of its websites, bringing all civil and criminal actions that may be legally applicable.

The IRTA cannot guarantee that the portal and the server are free of viruses and therefore cannot be held liable for any harm or loss that may be caused by these issues or any other of a technical nature. 

Modification of these conditions and duration

The IRTA may at any time change the conditions established here, being duly published as they appear here. The effective period of these terms and conditions shall be based on the publication thereof and they shall remain in force until modified by other duly published terms and conditions.

Jurisdiction and applicable legislation

The relationship between IRTA and users shall be governed by current Spanish law and any dispute shall be submitted to the courts and tribunals of the city of Barcelona.

Re-use of content

In accordance with Article 17.1 of Law 19/2014, the ©Government of Catalonia permits content and data to be re-used, provided that the source and date of update are cited and that the information is not distorted (Article 8 of Law 37/2007) and also that there are no contradictions with a specific licence.
